Can a person make a claim against my insurance company for an accident that never happened? No police report??



My son was driving my vehicle while out on a date with a young lady he'd met. He says that the woman got extremely intoxicated, started acting crazy, and jumped from truck while it was moving down the road at about 15mph. About a year and a half later, the woman is making a claim against my insurance company claiming that my son ran into a fire hydrant and now she has a neck injury. Of course the woman never made a police report because the police would have wanted to see the truck, and therefore would have seen that there wasn't any damage; but her claim is that she didn't make the report because she was scared. This all happened in MN and my question is what can they do? Will my insurance pay this bogus claim? I am a little nervous because she has some attorney who has taken up her case.

Call your insurance company and talk to them. There should be a statute of limitations in making a claim. So she was scared, tough. All of a sudden, a year later, she has a neck injury. She had better have some medical documentation to prove it. I'm sure your insurance company will look into it and have her examined by an independent doctor who can tell if she was recently injured or if it's an old injury. They also have ways of checking if she was involved in any accidents other than yours. She could have fell down the stairs, drunk and sees a windfall in claiming an injury from your accident instead of the fall.

Your son should have called your insurance company and the police at the time of the accident however just to cover your butt. We were stopped at a stop sign once and this guy ran his bike right into the corner of the car. No damage to my car, him or the bike but I insisted he give me his name. I didn't call the police but I called the insurance company and gave them the info. Nothing ever came of it but at least I had reported it. Otherwise he could have called them and claimed a hit and run.
One of two things are obvious to me here. Either the woman is attempting to commit insurance fraud by claiming injuries in an accident that never happened. Which is illegal. Or, your son has told you less than the whole truth.
