How long after a car accident do I have to file a claim with the other drivers insurance? |
I was babysitting for my cousin and when she came home she backed into my car...she has been telling me for a month know that she is going to have it fixed for me...or get the money...Have I waited to long to get anything from her insurance company...It will be thirty days the 28th?? Hiya: It's likely she did not report it to her carrier and is just trying to get the money together on her own to pay you. 8 out of 10 times......that turns out to be a scam. Fortunately you know this person. Get her insurance information and report it YOURSELF! You do not have to wait for her to report it. (Chances are she wouldn't do it anyway). When you report it - let the carrier know that you were going to wait for her to pay the damages but you don't want to wait anymore. You won't have to worry about anything else (as long as she has the appropriate coverage) and they should pay for a rental when your car goes in for repairs. ( in CA.) do the filing now. or u will not be covered for the damages. more than likely this person doesnt have car insurance and doesnt want u to report them. get it done now or u will be out the money not them... If it was an injury accident or a high $ amount of damage, you must file a claim with both the DMV and your insurance company within 10 days. Lots of times the other driver will change the facts about the accident so as to reduce his/her liability. So make your claims known ASAP. Provide pictures, drawings, and the exact details about the sequence of events of how and where this accident happened. Licensed CA smog inspector. (In most states and under most policies it is 1 year. However the longer you wait..... the harder it is going to be to win a claim if she is not co-operating!
