I was driving my firends car and had an accident. Whos insurance covers the wreck? My friends or me? |
I was driving my friends car and wrecked it. My insurance says that insurance covers the vehicle not the driver. Is this the opinion of all insurance companies? Yes, insurance follows the vehicle, not the driver. So, the insurance on the vehicle will cover the damages to the vehicle if there is collision coverage. Anyone can drive the car with the owners permission and be covered - you can look on your policy under definitions - who is an insured. The insurance on the car will also defend you since you would be considered an insured. If it is your fault and the liability is not enough to cover damages to the other party (for property damage or bodily injury), your policy will become excess meaning once the liability limits of the insurance on the vehicle are exhausted, your policy will come into play (now it depends on statute whether your policy will be pure excess over the other insurance OR, if your policy will only come into play if you carry HIGHER liability limits than the other insurance). Either way, if needed, your policy will defend you, whether it pays or not will be determined by policy language and state statutes. It depends on the insurance. When my friend wrecked my car, my insurance covered it and then went after the other insurance company. In the end, though, you are responsible. OKAY, IT WILL BE UP TO THE INSURANCE COMPANY BECAUSE IN MOST CASES JUST LIKE YOURS, IF YOU ARE NOT A LISTED DRIVER ON THAT POLICY THEN YOU WOULD NOT BE COVERED, BUT YOUR INSURANCE SHOULD COVER IT COMPLETELY LESS THE DEDUCTIBLE. 923 if your insured to drive another car yours. if your friends insurance allows any driver his. if his insurance doesn't cover any driver your pretty much screwed Your insurance covers it...you get to pay the deductible. His insurance will go after your insurance...you were the driver. Don't let this come between you. You both pay for insurance in the event of an accident...it happened. You were driving, as a friend...you would know this answer and take full responsibility. Friends don't jerk friends around. If he was driving your car, how would you feel? The driver is the responsible party. Get with the system and apologize for your delay in brain activity, and lack of being a good friend. Life |
