Changed car insurance and just now getting sued (car accident)? |
my dad was under allstate when he was involved in a car accident a couple of months ago. now he has changed to state farm and just today the other guy involved in the accident is suing him. who does he go to? allstate because that was his insurance when the accident happened or the new insurance which is state farm? thanks in advance... He needs to take the summons & complaint to Allstate immediately so that they can respond (I think there is a 20 day limit on the summons & complaint to answer it). They were the insurer at the time of the accident. I hope he reported it to them at the time so they could investigate the accident & determine fault. If he did not & this is the first notification, it could jeopardize the claim. Did the other party claim damages to his vehicle? Did Allstate pay for the damages? all state they were his insurance company at time Contact both companies with all the details, and they will sort it out. He will have to contact Allstate because the date of the accident was during the period that he was insured with Allstate. The insurance company of record at the time of loss is the insurance company that handles the claim, and that is AllState. It is chintzy to change companies just after an accident by the way. You expect the company to stand by you if needed, but show no loyalty afterward? In my opinion it is dirty pool to switch companies in the first year after any claim or possible claim.
