Car accident - Other driver's insurance threatening not to pay!? |
I was involved in a car accident that was the other driver's fault. He was cited for crossing double yellow lines into the turning lane resulting in the accident. I contacted his insurance company about getting a rental car and an estimate on the damage done to my car (which was towed away because it is not drivable) and the man I talked to was very rude and told me that the citation didn't mean anything and that they weren't going to pay for the damages to my car! So my question is can they really do that when the other driver was cited and was clearly at fault? You still have to call your insurance company. Usually they will fix your car for you and then they will go after the other insurance company. And since they (the other driver) was cited your insurance company usually won't make you pay the deductible to them. You have to report the accident to your company no matter what and they will be more likely to help you and be able to answer all your questions. Source(s): been in a few accidents. what about your insurance? if you didnt have any then its your fault because you didnt have a right to be on road.. talk to a lawyer y is your insuarnce not fighting with them i would call my ins and make them deal with it insurance will get out of it any way they can but dont let them I'd call his insurance again and ask to speak to a supervisor. Explain the last man's rudness and if the police report says it's his fault, bring it up and be firm, not bitchy. They may hope you just give up. If the second call doesn't work, speak with your insurer and ask them to take care of it. They won't let tehm get away with it. Ugh.. its not just that simple. You cant just get your "magic police report".. call.. and expect them to cover it right away. Theyre insured PAYS them to protect them in an accident. THis means doing a COMPLETE investigation (recorded statements from both parties, scene investigation, witness statements, police report) before deciding. If they cant reach their insured... this can take awhile. Plus, sometimes an officer cites someone and has no good reason why... maybe their insured is telling them a different story that makes sense. Liability is NOT based on the police report entirely. Look... save yourself ALOT of trouble and go through your insurance. They will attempt to collect your deductible back for you. You cant keep calling and complainning to the other party.. its not going to speed them up and its not illegal what they are doing. Uneducated people will say "insurance never wants to pay" and thats stupid and wrong. THey just must investigate and they always have to deal with impatient people like you. Cant you understand the other side? |
