I was in a car accident it was his faul and he has no insurance? |
He has insurance that only covers himself I still have to pay my car off it's not driving The guy don't have money if I take him to court what will happen How would he pay? woul he go to jail and not pay me? my foot is in pain, but I cant affort going to the hospital and he wount pay any idvice please It is certainly possible for the other driver to have insurance that only covers his car. It is a lienholders policy that only covers the physical damage to the car while the loan is still being paid. I see it all the time. He let his own policy lapse and the lienholder bought a policy to cover their collateral only. The policy is probably through GD Van Wagenen. This policy does not provide any type of liability insurance. If you have auto insurance you need to see if your policy has Uninsured Motorist Bodily Injury Coverage. You could use that to pay for your injury claim. You also need to see if you have Med Pay or PIP coverage to pay your bills. In some states you can also have Uninsured Motorist Property Damage coverage that you could use to pay for the repairs to your car. If you do not have any coverages on your own policy to help you then you will have to sue the other driver. But even if you win in court that is not a guarantee of payment. Good Luck. Or are you only carrying liability? You can sue, and get a judgement, but he won't go to jail, we have no debtor's prisons.
