How does getting a divorce affect my auto loan? |
How does getting a divorce affect my auto loan? get ready to lose it all buddy lign="right" > Sign in to vote! you need to call up where you got the loan, tell them the divorce is coming, then re-affirm the loan in your name.... hopefully you had it for a while and have established enough credit with them if you do not re-affirm the loan, there really isnt jack you can do with the car unless you have your spouses signature....... lign="right" > Sign in to vote! Don't do a thing until you talk to your attorney. That car may end up being her's as you separate all of your possessions. I got stuck paying for my car and her van plus child support and her maintenance. A good attorney will keep you from paying thru the nose. lign="right" > Sign in to vote! Well...if it's in yours and your spouses name, you and your spouse share 50% responsibility for the note. So, if you have the car, and your spouse is responsible for 1/2 of the note, and she/he doesn't pay (I didn't read your profile to see what your gender was, hence the she/he thing), you must pay the other 1/2 as well. So, if your credit is good, and you can have the car on your name alone, then I would make that one of the stipulations of the divorce. If you don't want the car and want out of the responsibility, again, try to make taking your name off the note a stipulation. |
