If you loan someone a big amount of $. People used me for $. Will not pay back loan. Can I place lien on auto? |
These people used me only to get a large amount of money from me on a loan. I have a promise to pay in writing. Now that I loaned the cash they refuse to pay the cash back now. Does anyone know of a legal remedy such as a judgement on a person or putting a lien on the vehicle they own? Please advise need info asap. Thank you Take it to small claims court (if the amount is small enough) get a judgment against them for breach of contract which will order them to pay back the money plus interest. Then if they do not start payment on the judgment within a certain amount of time. You can then take that unpaid judgment file it with the court and ask for it to be attached to their property. This will create a judgment lien on their car, house etc. This should work as long as the loan was legal under state law (not a usury amount of interest rate charged) You have to have something in writing first... like a signed loan agreement. take them to court, if they have written that they will pay you back, then that's good enough to get you money back in a court of law If you have an IOU, notarized, take them to small claims court or sue them. |
