MY BANK ACCOUNT WAS FROZEN--seized-- by a law firm claiming i didn't pay my Credit Card from years ago-a lie.? |
almost 5 years ago paid this off---Firstselect which no longer exists!-- but didn't keep the receipt of payment because i thought it was a done issue. what to do? i can scarcely afford a lawyer. it's been 6 months. please help. The law firm has provided NO proof! slabberdaske is probably right. The can not seize your account without a court judgment. Here is what probably happened.....this got into the hands of a collection agency, and the filed a lawsuit. They did a terrible job at serving you court papers (you probably moved and they don't have your new address)...so they did an "alternate service". So you were not notified of the court suit, didn't show up for the trial and they won by default. You will need to first find out how this the summons was served and see if you can fight this as an "improper service". Then you need to dig up some proof that if they retried the case, you have a very good chance of winning. It can be done without a lawyer, but you are gonna have to do some research. Let me know if you need help. You can represent yourself or try legal aid. Without proof they should not be able to do this. You should always keep these types of receipts. Things like this happen a lot. Would help to know what country you'e in; a private firm cannot seize an individual's private bank accounts in the U.S. Contact legal aid to see about getting a lawyer for yourself. The law firm needs to provide proof to your lawyer. You should have been looking at your credit report at least once every six months. If you had, you should have seen that the debt was still showing as open. Going forward pull copies of your credit reports often to keep an eye out for errors. As far as finding the form of payment. How did you pay the bill? With a check? If so, call the bank you did business with back then, they should be able to find a record of a check or fund transfer. Being that it has been sometime there might be a small fee to find the payment. In the US, a creditor cannot seize any assets without first going to court and getting a civil judgment against you. If they have a judgment and your were not properly served, it is possible to get the judgment set aside. Ask them how and where they got the judgment, then check with that court. |
