Can the bank withdraw money from my account when they claim they over paid me on a cashed check? |
I cashed a few checks at the same time and am certain that I was given the correct amount from the teller but they say she gave me too much.How can they prove that I was the beneficiary of her error? make them prove it, if they can not prove it sue their asssses, if the teller messed up and gave you more money then she was supposed to it sounds like a banking problem, not yours this really pissesss me off, jeez im sorry guy/girl thats effed up yes they can and they do you can't.... Banks have a definite procedure as how they balance out their tills each transaction is registered if they feel an error is made they start with the first transaction of the day and count down to the last transaction they also know how many $10, $20 etc. they opened with that day. They balance with how many checks were taken how much actual cash was taken in. At the end of the day the top and bottom figures have to balance. Now you could ask the Branch Manager if that particular teller was long or short for that day. I think its a fine line if they can dip into your account because they have a specific time frame that they can legally do that. You need to contact your State Banking Regulators they will give you the parameters and also are they an S&L Credit Union who are they controled ( what type of banking entity) that will also determine guidelines They can't do that!! they could've paid it to anyone |
