If at a Bank ATM, you do not get the cash but your account gets debited, how do you get the money?



In one of the instance I approached the Bank Manager of the place where ATM was located. He simply said he is not responsible for anything that happens in the ATM though he maintains and keeps account of that ATM. He did not listen to my complain.

I approached the Bank branch where I have my account. They have taken an application from me, and informed me that they will not be responsible for my loss which may be caused to me due the use of ATM Card issued by them for which they charge me Rs 50 as fee annually.

Ideally speaking bank should return the money as when they reconcile the cash balance in ATM, it will show excess on that day which will tally with your amount.

However it is very difficult situation in case bank refuses as you do not have any proof to prove that you did not get money.

Do two things - file complaint at both bank where you withdraw money and where you have account then send a notice to you bank. After that file a case in consumer court (Upbhokta adalat) and write a letter to Bank Ombudsman (Bank Lokpal).
File a credit/debit card dispute with you financial instatition, if you haven't already done so.

If you already did and your bank says they are not responsible or liable, you need to find yourself a new bank. Most large nationwide banks have 0% Customer liability for unauthorized and incorrect charges, if the machine did not give you cash, but debited your account anyway, most banks will back you up on this.

It sounds like you need to close your account at that bank and check another one out who will help you.

It depends on the bank... i experienced it too. I reported it to the bank where my money has been debited. they ask me to file a complaint on that bank. then after two weeks they return the money on my account. Actually, they told me, they will be automatically return it even if I did not file that complaint.
Sounds like your bank are full of s**t! I'm in the UK and until recently I worked for a major bank. If money is taken from ATM and no cash given, it's up to your bank to get it back for you! Even if the ATM was for an different bank! If you're in the UK, and don't get satisfaction from your branch manager, ask for ta copy of their complaints procedure and follow that. If they don't give you one go straight to the banking ombudsman. If you follow their procedure and your still not satisfied you can then go to the banking ombudsman.Don't let them shaft you! it's only a few quid to them but to you it's the principle!
