There is no federally law that prevents non US citizens to open a a bank account in USA. Foreigners been opening bank accounts in USA for decades. However, under the Patriot Act, you will be required to provide several legit IDs to open an account such as a passport, your Tax ID number, and so on. Bank of America will soon be , or they may already be, offering savings accounts to non-citizens...you don't even need a social security card...I would call them or visit their website
