If a bank account has been frozen can bankruptcy recover those funds? |
I have a bank account I use for paying my rent (landlord in another state). I had a judgement from 3-4 years ago. It went to collections and they have frozen my bank account. I have since filed bankruptcy. The funds are still frozen and not delivered to the collection agency. Will that money now be returned due to the order of stay by th BK court? Since they only started the process but have not fully taken only frozen the money will I get that money back under the protection of the bankruptcy ( chapter 7). all your assets are frozen and will be distributed to your creditors by the courts it often takes a long time to complete and once they have satisfied your creditors any left over funds will be released to you. (VERY RARE ANY LEFT) bank accounts, and all disposable assets are seized first and then it is their decision if you will have to sell personal assets such as cars, homes etc to pay your debts. You should have removed all the money before you filed. now it's too late and you can't keep it. This is a question for the attorney that's handling your bankruptcy. Make him/her earn the money you're paying. |
