Can my bank pay a post dated check early? |
i wrote a post dated chaeck for my rent dated it for 8/31 I go online this morning and find my bank has paid it and now I am totally F'd/ Were they suppose to cash that check , doesn't my post dating it say I KNOW I will not have funds avail? OMG what am I going to do now? Call your bank and complain. Explain to them that it was a post-dated check and that it should NOT have been able to be cashed yet. The teller should have caught that. The bank is legally bound to cash the check on demand, post dating is more a matter of honor between you and the person you wrote it too. Take it up with your sh--ty landlord. The post dated cheque must have been paid in error and am sure if you take up the matter with your Bank they should be able to make the necessary refund. This is type of mistake happens when the payee Bank official scrutinizing and paying inward cheques overlooks the date of the cheque, but once highlighted by the affected customer, the bank will normally make the necessary reversal. Your landlord should not have deposited the post dated cheque before due date, and should therefore be the one to bear the usual penalties levied by banks for returning cheques and or any other cost involved. Alternatively, to avoid financial cost to your landlord and the usual blame game with bank officials, you can mutually agree with the land lord to refund you the cash and then you replace the cashed cheque with another post dated 8/31. Whatever option or decision you make, there will still be need to let you bank know about the mistake so that they can take corrective measures to avoid a repeat of the same. Wish you all the best. |
