If a friend loans you money and the check bounces who is responsible for the bank charge? |
i asked a friend if she had $150.00 that she could loan me. she said yes and wrote me out a personal check.. i told her i was expecting a check in the mail the next day and would repay her.(this was not a condition for the loan i was just letting her know i would have the means to repay the loan in full soon) later that same day she went to a local casino and over spent her account so when the check she gave me went threw her account, the next day, she did not have funds so it incurred an overdraft charge. Who ultimately is responsible for this charge? ( of course the check i was expecting was late but she has been paid) except for the overdraft fee This is hard. She was being nice and doing you a favor. She was also irresponsible by not watching what she spent when she knew that you had the check. She really is the one responsible to pay the fee because it's her account and you had no idea it was going to overdraft. As a friend that did you a favor you really don't want to leave her high and dry even though she acted foolishly with her money. If it's a good enough friend to loan you 150.00 you may not want to loose that friendship. Had she not loaned you the money it may have not bounced. It maybe a good time and step up to the plate and offer to pay half of the fee. Just to keep the friendship sailing smooth. Good luck. :) she is and she should be embaressed Whichever one of you incurs the charge is responsible for it, but since the guy was doing you a favor, and it's on his statement, you might offer to pay for it, or split it, and never borrow from this one again. She is of course, why would she think otherwise? Your friend. If she knew she had lent you that money, she shouldn't have spent that money. 1st, whoever gets the overdraft need to pay it. 2nd, SHE is 100% responsible, in my opinion. She shouldn't have spent the money in her account knowing she had loaned the money to you ALREADY earlier that day. she is. |
