Can a loan company get a judgement against me and garnish my bank account? |
this company had insurance on me then canceled it now i am disabled and they want me to pay them back.i offered to pay a monthly payment and they said it was not enough. so they are going to get a judgement on me can they garnish my bank account also.i live in north carolina If it was in your contract, they can. They do have to follow UCC Codes. They have to get the judgement and a court order allowing them to garnish wages and/or bank accounts. If the account is in a joint name, say you and your parent or spouse then it is more difficult to get an order to have it garnishment. Good luck, Do a search on UCC Codes and if all else fails and you are in serious finacial trouble you may opt for filing bankruptcy. |
