Is a company in violation of the fair credit act if they continue to call your home/business when told not to? They must be told in writing to not call your home/business. I wouldn't recommend sending a full cease and desist if you are still within the collecting SOL. Doing that leaves them no choice but to either sell the account to another agency or to sue. You can send a limited C&D that tells them not to call your home or place of business because it is inconvenient to you and any further correspondence from them must be done by USPS. No, simply telling them to stop is not enough. The thing to do is to send a formal "cease and desist" letter. Having a lawyer do it is best, but you can find form letters to use yourself with a Google search. If they keep calling after that, you can sue them for damages. http://www.quitecontrarian.com No, but they are in violantion of the Fair Debt Collection Practices Act. |
