check was for 3000 dollars and he doesnt want to pay it i can cash it right I know it is on a closed account. what are laws about him giving me bad check on closed acct Go to your prosecutor's office. Ask what to do. You may be able to sue in small claims court and get a Judgment. A word to the wise, never lend money that you ever hope to see again. If you can't afford to lose the money with no strings attached, then don't lend the money. Good Luck Take him to court, they will garnish his wages if they have to. KICK HIS ***!!! Turn it over to the district attorney for theft by check, we prosecute stuff like that all the time. You might as well throw it away. Sounds like fraud to me, but I'm not a lawyer. You could go to your states attorney or state attorney general with the check and see what they can do for you. This happened to an organization I worked with and they were wonderful, prosecuting the guy. I think they worked so hard for us tho was because it was a sports organization that worked with community kids. As an individual I don't know what they could do, but it's a start; Small Claims court is another route, but I'm not sure what the limit on damages is where you are, At the end of the day, if this person has no money, even having a judgement against them won't insure you get your money back. Next time think longer before you loan, get a contract, and get better collateral |
