I owes taxes and I have 74 thousand in the arears for child support.Can the state take it from what is owe 2me



The state has a lein on the non-custodial and will not collect he is working with a union and hasbeen working for 35 years. but the money just builds.And now I owe taxes with a teenager.

My girlfriends dead beat dad owes 60K in back child support, and maybe 50k in taxes.

The state has been trying to collect so and IRS and state taxes. He has started paying child support. Child support always trumps tax liens. Since IRS and the State tax commission hasnt gotten anything in 2 years and the issue with child support.

He was just indicted on 6 felony counts on child support and tax. He is facing up to 60 years in prison, with most of the felonies requiring a minimun of a year. Thats just for the state charges.

He will be in jail for awhile and yes they can come and take everything he has and they will, including his freedom. Trust me they will go after him. But you have to keep pushing it. She didnt want to put him in prison but once the state gets involved its not your choice. But any money they collect goes to child support first.

If the state has a lien on the non custodial make them file a garnishment. Thats what my ex girlfriend did. The union cant stop that. They can take up to 90% of his check if he is self employed I think its 50% if not. Call them every day until they do something. Its your kids you have to feed. Its about them, not him.

I just read what the other poster just made, that might be right if IRS or the State Tax commission isnt going after him. But when they are going after him and they see no way they are getting money. They file criminal charges because they know they cant get a dime. It depends on the person at the tax commission once they file so does the state and its all about 3 hots and a cot.

If you have one or the other I bet you could make a deal. But you cant make a deal with taxes when you owe child support. They know they cant garnish him and it will piss them off. Source(s): Dating a girl that has gone through this for the past 2 years
The short answer is no. It's a shame but that's the truth. My suggestion would be to call your ex spouse and cut a deal. It's not ideal, but it is probably the best solution for your particular situation
Sorry for your situation, but if you owe taxes, it cannot be offset because someone else owes you child support. Others have suggested you be more aggressive about getting that child support, hope you can do that.

The person who suggested you cut a deal with the father is mistaken about child support. You cannot negotiate away your child's right to that support. Your child could sue for that support when he is 18.

Have you been filing correctly and getting the credits due to you? If you have been doing your taxes yourself, have them reviewed to see if your tax bill can be reduced.
