My income tax refund was used to pay towards my husbands child support is this the new illinois law now?



we have been married 6 yrs. i always file injured spouse he doesnt work but we file jointly.the illinos dept. of revenue sent me a letter of offset stating my refund is to go to his back child support payments, now naturally no one at 1 800-732-8866 knows anything. is there an injured spouse for Ill.
or am i going to be paying for grown children i don't know?

You filed injured spouse, but that only goes to the IRS, not the state, which is apparently who is taking your money. You must fill out an innocent spouse form for Illinois, at the sites below. Source(s): http://www.revenue.state.il.us/taxforms/...

I'm not sure specifically about the state of Illinois, but from my experience, this is a situation through the federal government. Yeah, it looks like your refund will go to pay back child support because you and your husband are filing jointly and your money is his money (you many not feel this way, but this is the case according to the government.). I know it seems unfair to you. Try to think of it from his child's mother's point of view. She'll take the money she is owed in anyway she can get it. And she should. She is owed. For this tax year, you are SOL. Next year, ask your tax professional (or call the IRS directly) about filing seperately. You can still file married, seperate returns. That may help, but ask to make sure.
