he pays 125 a month and is still behind cause we didnt know the child exsited untill about 3 years ago and then we cant get a dna test and they were not married and she didnt even live in our town but she chosse him out of 10 other guys plus she was married when she gave birth

Yes indeed they can! It depends on your judgment. If he owes ANYTHING AT ALL, regardless of whether he's paying on it, they can take it from his refund.
