Should a custodial parent of a child sign 4 the non-custodial parent 2 receive earned income tax credit ? |
non-custodial parent wants to or thinks he deserves to get the earned income credit every other year what do u think about this? No, I think the mother or current guardian should claim the child. You shouldn't let someone claim the child because they'll make a habit out of it. And remember that this year they started investigating who claims a child and why. hell no! NO, NO, NO, NO!! EIC is for the custodial parent...it's a tax break for low income families...why would you give money away that's meant for your kids This is an issue only you can answer. If the non-custodial parent pays their child support and any additional money owed for the support of the child and you can afford to lose that credit every other year, then Yes I think it is fair. My ex-husband pays support, but doesn't buy them any clothes, won't give them lunch money, doesn't pick up anything he isn't court ordered to do, so I don't feel the push to offer that. It is an idividual decision, not really a matter of what is "right" or "wrong" Ya know what I mean? If he pays his fair share of child support, and takes the kid for visitation, then you should split the tax break every other year. My ex-husband and I have two kids between us, and he claims the oldest, and I claim the youngest. But, he pays his support and takes them one day every weekend. When you have your taxes done, you should ask. LEGALLY, he/she is both of yours, and is a legal dependent of both of yours...He might have legal repercussions against you if you're not "fair" about this. This is, of course, assuming he's a responsible parent. When we filed for divorce, the lawyer made sure this stipulation was included, (that we split the tax break), so there might be laws governing it. As I said, you should ask an accountant or a divorce lawyer to find out for sure. OOPSIES...nevermind...this is about EARNED income tax credit....sorry, thought it was about claiming dependents. I was going to delete the entire answer, but decided to leave it as it might help someone, somewhere. As far as I know, earned income tax credit is supposed to be for the family who retains CUSTODY of the child for the majority of the year. That would be you... ALSO...if he makes little enough money, even without a child to claim, he might qualify. It's based on income AND family size. no... the other parent is paying child support right? well he can claim that he pays child support. also he can get child support token out of his check before taxes are taking out.. nope! I sure wouldn't do it! And just to let you know... You are not garenteed to get this money I talked to my tax person this year and it only helps you out... If you make to much money and have to pay in this tax credit helps... I thought if you had kids you got it no matter how much money you make and that is so not true!! I have two kids of my own believe me... We've been through it.. |
