I pay child support and my childs insurens but she lives with her mother, will i be able to claim her for tax? Its depends on if her mother is carring her. Most likely she is. If the child lives with you you get moey if not well only if the mother is not carring her for taxes. Anyone can carry her but check and see i dont think so if your ex tells you that you can claim her that she won't then you can, but if your ex claims her and then you do, you will get in trouble, you won't get any money and you won't be able to claim you're kid for 2 years. if you do it again you wont be able to claim her ever again That is usually worked out in Devorce settlement who gets to claim child if not I believe it goes to the parrent the child resides with However I beieve you do get a tax deduction for chid support and Medical expences if you file a 1040A it is best to check it both ways to see if you have enough deductions to take the long form. If you can get the mother to aggree to let you claim the child then ok otherwise I would not if it wasn't aggreed upon in the devorce decree. If your divorce decree says you can carry the child, then you can. Otherwise, your child would have to meet the dependency test: who did she live with for more than 6 months of the year, adn who provided over half of her support?
