No. If he is taking care of him then he can claim him. If he gets audited, he just needs to produce receipts that he has provided care of the child.
bad in what way? if you have a court order for child support, and he's due a tax refund... and the arrears are a lot, then they make take his tax refund.
tax refund intercept... call your caseworker and ask if there is one on your case to intercept his tax refunds or not.
and if you dont have a court order for child support, get one. heres a link for child support; just click on your state and fill it in, that'll give you an idea of what will be paid...

Is he now supposed to pay child support? If so the fact that he's not means he can't claim your son and would get audited if so. You claim your son and get that back. If he's ordered to pay then his check will go to you.
No, you are together their is no court judgment on custody/support. Sounds like you should consider marriage as it sounds as though he's stepped up to the plate to care for the both of you. As long as you both do not try to claim your son as a dependent for tax purposes there is no problem.
Would like to add depending on your and his income you should see who would benefit most from earned income credit, this could give a boost of cash to the family. I take it you guys are cooperative and living as a family. Even if you do not have an income you can get earned income credit, talk to a tax preparer.
Get married. It'll fix everything.
If you are receiving welfare or other public assistance they can file a court order on your behalf and he can get a warrant isssued for his arrest if hes not paying them. Otherwise you are fine as long as he is taking care of you & the baby. But if he ever does leave I would suggest filing an order as fast as you can.
