Contact the IRS. It is illegal what he is doing. If you're doing this to get back at him for what he has done to you, leave him alone. Karma will get him better than anything you can do to him. When we take vengeance into our own hands things can get ugly and you can end up regretting it.
check irs.gov because I don't believe a noncustodial parent can claim the kid

Yes it is illegal if he doesn't have custody of the children. You could either report him to the IRS or claim the children on your tax return and when the IRS checks into it, he will get caught when you prove to them you have the legal right to claim the children.
yes only one parent can take the deduction, if they are caught they will get in trouble
It is only illegal if he is A. not the father (step father, biological, or otherwise) or B. he's not caught up on child support. Call a lawyer and talk to them, they'd know more about it.
