Can my child's father legally claim my child on his taxes this year? |
I have claimed my son every year since he was born and never had a problems but now my ex boyfriend (child's father/sperm donor) is threatening that he will not give me a choice this year and he will be claiming my son. First, he has only seen my son one time in the past year. Second, his parents (my sons grandparents)have been paying his support for him every month since my son was born so none of his income is going toward support of my son. Third, he only pays 331.00 in child support. This is not even close to half of my sons support. I can't fight with him directly about it for concerns with violence but can he really claim my son? and if not, what can I do if he tries? the federal tax code says whichever parent has physical custody claims the child.......he would have to live iwth his father more than 6 months out of the year in order for him to claim him. go ahead and claim him yourself and if he claims him as well they will contact you...just show them that you have custoday and voila.....hes committed tax fraud. I would say no because you are the one who mainly supports him and if he does you can probily take him to court and fight over it just because he doesen't do crap im pretty shure that you can legally make him not the father only pays 331.00? OK, lets see... -rent; 1000 -electric 300-500 -food 100-300 -heat 300-400 -phone/cable 100 -water bill 50 -sewer bill 50 THESE ARE BILLS THAT THE WOMAN WOULD HAVE IF SHE HAD KIDS OR NOT!!!!! so lets see diapers 75per month (if your too good for cloth diapers ) -formula/food 200 clothing/shoes/boots 100-150 every 2 to 3 months this is about 325 to 375 a month so now lets be FAIR and divide The ACTUAL cost of the kid that's 162.50 up to 187.50 a month judges can add well there problem is in there division No, he can't - you didn't agree to it or sign anything. so, just go about doing your taxes as always(try to be the 1st one to send it in)- then they just send something to him saying somebody has already claimed him. IRS might send something to both of you to prove that you can claim him- you have custody- you win. He's yours to claim. don't even argue with him about it- let it go- and just claim him. |
