Why can't you claim children on your tax return when divorced? You can. or your spouse can. but only one of you can and you better talk about which one is going to because if you both do it you will both be audited. Normally this has to be worked out by divorce lawyers and it takes forever. Some say you can alternate years or one spouse can claim one child and the other spouse can claim another. You can....unless your ex claims them. Every situation and divorce is different, In my divorce papers, I get the kids for all tax purposes, Therefore, My ex cant ever claim them again. It really depends on the divorce agreement. If the divorce agreement doesn't cover it, it will typically go to the custodial spouse. |
