In a maryland divorce who gets to claim children on their tax return is it whoever pays more than 50%?

Most divorce documents these days address the issue of claiming the children. Whom is the custodial parent? Just paying child support does not mean that you automatically get to claim them.
That or by agreement. Assuming shared or joint custody.
Current tax law gives the child to the custodial parent, period. In joint custody you have to determine who had the kid the most days. In reality however, either parent can claim the child as long as the custodial parent signs a form agreeing to let the non custodial claim the kid. Only if parents cannot agree does the rule re: the custodial parent come into play.
