In my divorce papers i claim the child on my taxes my ex claimed him what can i do? Report him/her since you are the legal guardian. File as you would normally and send the divorce papers along with the return. You'll receive notification from the IRS with the duplicate claim. Your ex-spouse will have to prove he/she is entitled to make the claim. if you provided more than half the support for the child, even by a penny, then don't sweat it, he made a mistake. If not file an amended return (Form 1040 X) and pay the extra tax If he already claimed him this year before you, then if I were you, I would also claim the child and when the IRS sees the matching social securities numbers, they will send you both paperwork and you will be able to prove that you were suppose to claim the child and he will have to pay it back. Or you could take him to court and get the money if he hasn't already spent it. Both of you will get letters from the IRS stating 2 have claimed him. YOU are the legal guardian so be sure to definately cle=aim him. The irs.gov website has an 800# that you can call and nail his *** before they send him a check. You can get a form from HR BLOCK or the IRS called an 'injured spouse' form.Fill that out and send it in. make sure you send a copy of the page (in your divorce papers )with your taxes .thats what i had to do .if you sent them already they may ask for it later |
