Can a noncustodial parent write off child care expenses on taxes? only the persom who claims the child as a dependent if you were a noncustodial parent you wouldn't have child care expenses if you can show proof thatyou paid for it, then yeah Nope. Under the new rules, a child is defined as the same thing for dependent, EIC, and child care. You can't split the credits for the same kid. The CUSTODIAL parent is the one that has the right to claim the child as a dependent and the right to claim any child care expenses paid for that dependent. The exception being that the custodial parent files a waiver letting the Non-custodian parent to claim that child as a dependent. This would generally be done as part of tax planning as the non-custudial parent would then claim the child care expense paid on that dependent. |
