When filing taxes and ex owes child support, do they take the check if they file my son as a dependent? |
My ex is filing our son on his tax return, but he owes child support. Will it get taken from him? And where will it be sent? Does this mean he can't give it to me? Yes, his refund will still be taken from him. The refund will go to the child support division first and then to you. It'll take some time but eventually you'll get it. Regardless of whether your ex puts your son on his return, the IRS will take the refund to cover back child support. My experience is that if the government has it on file that he owes child support, they will dock his refund check before he gets it. They do this by Social Security number. If he has remarried, they will dock his wife's check too, if necessary, depending on how much he owes you. Only one of you can claim your son legally. So if you don't claim him, your ex can. That is how I understand it from experience around some people who have had this happen to them. If he had custody of the kid would you pay him child support? When you file your taxes, claim your son as your dependent, and notify the IRS, that you are owned back child support, so he cannot claim the child as a dependent, you will have to file a complaint at the courthouse, or call your divorce attorney to get the monies he owes you. You need to check with your child support unit and see if your case worker has filed a petition with the goverment to take his tax money. If they have then yes you will get the money. if they haven't, he will still get his check. good luck... |
