If his gross income is below the filing requirement amount, absolutely nothing. If it's above the filing amount the IRS will eventually come looking for a return however if it looks as if he'd be due a refund they won't normally pursue the issue as there's no recovery for them.
It's entirely possible that you're dealing with a dirtbag who would rather let the IRS keep any refund he has coming than let it go to his kids. That's just plain sad.
If the IRS isn't going after him, probably the only thing that you can do is to go back to court and try to get a judge to order him to file any tax returns so that any refund can be offset towards any outstanding arrearages. Your attorney can advise you if you have much chance of success with that.
Jo Blo makes an excellent point. You have no way of knowing if he is filing a return or not. Just because he tells you he isn't doesn't make it so and the IRS will not discuss his return with you. If he would have a refund coming on his taxes, then nothing would happen if he didn't file - the IRS already has their money. Technically he's breaking the law by not filing, but if he didn't owe anything, they won't really care.
If he's just not filing to keep from getting his refund taken for child support, he's not thinking very clearly - this way he's forfeiting the refund AND still owes the support - if he filed and his refund was taken, at least the amount of back support that he owed would be reduced even though he wouldn't get his refund. could it be that he is just yanking yer chain? Maybe he really does file and tells you something else? he's not filed because he owes child support arrears?
report his azz to the IRS. they will MAKE him file, after his audit... then YOU GET THE ARREARS OWED.

If he is not filing because he owes back support he is really doing himself and your child a disservice. First he will be fined when caught and IRS debts will be seized to pay off tax debts prior to paying his child support arrears.
