Is it legal for a married couple to file taxes separately and claim 1 child each of 2 children? no i think that if you are married you have to file joint taxes. Married persons CAN file separate tax returns and claim 1 child each, but CANNOT claim the EIC deduction if filing status is "married filing separately." I dont think it would be to your advantage to do that ... better tax credits come for married jointly and with the total dependants. That may be different for divorced people. You should get a program like Turbo Tax and figure out each possible way for getting the most money back. I am pretty sure it's legal (call the IRS) but I don't think you'll want to after you see the results. www.irs.gov Yes I would say you can do that but it will cost you more money as you both will pay a higher rate of base taxes,it is almost always better to file together..... its not to your advantage to file in that fashion. Married filing jointly offers the best tax breaks you could possibly get especially on your child income credit. |
