Myif a married man is in the rear in child suport and his wife file taxes will the hold her taxes? |
the wife file head of house hold and claims the husband Coming from a wife whos husband pays child support, If you file married filing seperatly the ex wife cant get her hands on YOUR return. You didnt have kids with her so what HE owes her can not be taken from you. However, she can take her fair share of His or a Joint return. Hope that helps. Best of luck. I think.what you asked is...if a guy is behind in his child support will the state/federal government hold the tax return and pay what he owes out of that money. The answer is yes. If the return is more than he owes....you guys get what's left and yes even if the woman he's with now files as head of household...they still get ya. Legally she can not file head of household but she can file married filing separate with a thing called injured spouse. Then she can get her money and they won't take her taxes for his child support. yes you cannot claim the husband as a dependant. You must file married but separated. I've heard of two people I know having this problem. One said they filled an "Innocent Spouse" form, the other called it an "Injured Spouse" form... Nonetheless, it was to protect the innocent spouse from having her portion of the refund taken for the husband's child support debt. But both told me it did not fully protect them, some money was still taken. Call the IRS they will tell you. Speak to a person who does taxes professionally. If they file joint the wife can file an "injured spouse" claim which will limit what they hold to the husband's share of the return. personal experience |
