Can I claim a tax deduction on money I gave my children who live with my x? |
My x-wife lives outside the US and doesn't work, nor files tax's. Each month I send my kids ages 12 and 17, who hold U.S. passports and are U.S. Citizens money for support. They live with me 4 or 5 months out of the year. At the moment they do not have a Social Security numbers. Can I deduct some of that support when I file tax's? The money you are giving is Child Support and it is not deductible on the Federal Tax return. Source(s): Internal Revenue Service 1-800-829-1040 No, support is never deductible. However, you should get SSNs for your kids immediately. Since they are US citizens and your ex is a non-US national who is not subject to US tax law, you can claim the children as dependents you YOUR return. You can't claim them as dependents until you get SSNs for them, though. Just don't get caught! You should have an agreement to alter the years deductions. Nope. Money you give to anyone isn't deductible, nor is child support if you were paying it that way. Without social security numbers, they don't qualify as dependents either, so you can't claim exemptions for them. |
