Tax question. I am single and have two children, a boy and a girl. Both children have different fathers.?



I want to claim the boy and file HoH. My bf wants to claim the girl (he is her biological father) and file HoH. We both made over $3,300. Is that the correct way to file? Is that legal?

Do you all live in the same household? Then the taxpayer who pays over 50% of the household expenses should be the one to use the HoH filing status. The other parent uses single filing status.

If you live in at the same address and both file HoH your returns may be examined as an incorrect filing status will have been used.

You can still get the credits for the child with the Single filing status. Your refund will not change significantly.
well first off, are you two filing joint or seperate. if joint and living in one place then there can only be on Head Of Household and that is the same for filing seperate. You guys can each file as the HOH is each of you live in different places and pays more 50% of that household expense. Regarding to the dependent claims, there can only be one claim for the children per person and the rule for that is whoever is the first to claim the children as a dependent then he/she gets the claim.
If you both live at the same address, I don't think there can be 2 HOH but we are not the IRS, ask them , not us . . .

NOT IF YOU BOTH LIVE SAME ADDRESS..NOT LEGAL.
WOULD HAVE TO BE DIFFERENT ADDRESSES....THEN YOU COULD..
