Can my ex get back due child support if my wife and I file taxes together this year?



Will my wife's cut of her return go to my ex for back due child support? What should I do to avoid that?

Your spouse needs to complete form 8379 Injured Spouse Claim to protect her portion of your refund. Based on her withholding the IRS will compute what portion of the refund she is entitled to

If you haven't filed yet make sure the 8379 is send with the return. If you filed already., she needs to complete it and send it in immediately

this happened to my sister, her husband didn't pay child support and when she got her refund it was less than half of what she thought she was getting because his ex got it!
