I have joint custody of my child and also pay my child support, can i claim him on my taxes? You should talk to the mother & make sure she hasn't already claimed him. If she has & then you do too...you could get into trouble & end up having to pay back any refund you might get. In my case I had it fixed where my ex husband can't claim our son because then he would just get back all the child support he paid for that year & I wouldn't get the refund. Every situation is different. The child can only be claimed once. Look over your divorce papers, it should specify who has the right to claim dependants. If it doesn't specify (which means you had really crappy divorce papers), the person who the child lives with more than 50% of the time gets to claim them. usually that is something that is put on paper before everything is agreed upon. In my case the father and I switch off each year. I get this year and he gets next, back and forth, but he dont have joint...your case because it is joint could be different If it is joint, then she pays you when you have the child ?
