If I owe back child support, when my new wife and I file our taxes, will they take her refund?? |
I owe Back support, and last year when i filed, my refund was sent to my babys mom, i was single then, but now i have a wife, and we dont know what will happen with her refund when we file. When the two of you file your return, your wife can file an 'Injured Spouse" form with it. Injured, in this case, means that she could be financially harmed. She is the injured spouse, and the form will allocate the income and refund between the two of you, and asks questions about who owes the debt. It's a fairly simple form. When you have your return done, at least have it checked over by a professional. H&R Block will check it at no charge to ensure that you're getting every deduction and advantage possible. Also, be aware that filing seperately may not prevent them from taking her refund against your debt. Your Social Security Number and name still go on her tax return when you file seperately. You may try calling H&R block and ask them. If you file jointly chances are you wont get a refund this year.
