I have a question about using my children as deductables when filing taxes? Urgent!? |
I would like to know if my Fiancee can claim my children on his income taxes this year? If it would still go under the category as foster children? We live together, and he is the provider for the home. He is the one who brings in the money. Thanks in advance! That would be based on whether or not, he is the soul provider for them.If there is child support coming in, or any help outside of the house,it will affect whether he can claim them or not.Ask a local tax preparer in your state. If the children is not his (either through birth or marriage), he can claim them as dependents ONLY if they lived with him for the entire year, and he provided at least 50% of his support. But.....they aren't his "foster children" unless they were placed with him by an agency....... The dependency rules changed last year for 2005 and forward. Because the kids are yours and not his, he can not claim them. yes he would be able to claim all of you. as long as u have custody of your children then you both would still get your child tax credit. He can't if he isn't the biological father of the children. They are your qualifying children, so not his dependents even if he supports them. They would only count as foster children if they were placed there by an official agency, not just because they live with him. Not the same as foster children. Foster children are a different category. He would claim them as dependents outright. I was in foster care for ten years and have been a system activist since 1999. |
