If two unmarried people are on a deed can one get a line of credit against their equity without the others ok? Not in general. Both signatures will be required as both peole have a stake in the equity. The nature of those signatures will be different. The other party's "consent" is typically a situation...but this DOES require a signature. In addition, the matter can be more so in favor of a signature if two people are living together in the house and have done so for at least one year. The house is considered a so-called "matrimonial" home. Hope that helps No, both of you would need to apply for any additional debt secured by that property. |
