Long-term disability insurance wants 2nd psych evaluation after complaint is filed...Is this legal?



How can I stop these people from harrassing me, and interferring with my recovery? I've paid into this long-term disabilty policy for years now, but since I've been recovering from severe depression I've had nothing but trouble from them.

First they approved my case, then months later they required I undergo a "routine interview" conducted by some 3rd party admin company (not doctors). Then they ask for my doctors pysch notes, I declined of course, but my doctor sends all requested records regularly, aside from his private notes.

Now months later they want me to undergo an evaluation with THEIR psychologist...which of course will be bias in their favor, and how can some guy that never met make any kind of VALID assessment of me anyway?

All of this becuase the insurance rep believes...in her words, "you've been depressed for months now, nobody can be depressed that long". I've asked that she be removed from my case, but they won't allow me to change reps. HELP

There may be a clause in your disability that says if you suffer from the same illness within 2 weeks after return to work that its considered to be a continuation of the same illness. If they say you are fit to go back to work and you aren't, just fake it and go on disability again. You will have to check your insurance company's policies regarding this.
You aren't the only one who has to fight those #$%#$% blood suckers and yes it does lengthen the recovery time. From what I have been told, its normal after the short term disability period that you have to reconfirm your disability for long term.
If they have you on antidepressants, just go off them a couple of days before the meeting. This will probably make you real depressed but then it will only prove you are not ready to return to work. Of course, staying up all night is a good idea too so that you can say you haven't been able to sleep properly (which is a symptom of depression). Clenching your hands and being fidgity is also good.
Two can play that game. I've been depressed for four months now and am slowly getting better. My psychiatrist wrote a letter saying it will take months if not several years for me to recover. You might ask your doc for something like that.
Some people are depressed for their entire lives. Others get better with the help of medication and therapy. BUT, some of those need to keep taking the meds and doing therapy for the rest of their lives.

Before you go to their psychologist, get a note from your doctor explaining what he/she feels is wrong, and how long it may be expected to last. Bring that note with you.

Insurance companies have gotten away with a lot of crap--it's time that they were stopped--otherwise, what's the sense of paying for insurance?
as far as i know they can do that.the case manager sounds like a idiot but you cant change stupidity.go through with the evaluation get it over with.talk to your reg.psych.doc and see if he /she can help.and they are doing it because no insurance
company want to pay out.no matter how much you paid in.but if they keep being a pain you could try the insurance licensing
board.each state has one.they might be able to tell you what to do
and you could always try a lawyer.
