Will I lose my Social Security Disability Insurance(SSDI) for a felony Drug conviction? |
I was visiting my family in New Orleans, and I had to evacuate for Hurricane Katrina. I was home helping out after the storm all I could. I turned down cocaine at least 20 times, but I finally did some, and then took some from my cousin. I was going to fly back to California( back to school) and and got busted by the security by their search. If I take the felony charge, will this effect my SSDI/SSI and the help from The Department of Rehabilitation? If you are in jail for 30 days on the felony conviction, your SSDI benefits automatically end. Social Security checks jail and prison records to ensure that money isn't being handed out to people behind bars. There were big scandals in the 90's about people racking up large amounts of money behind bars - some of which went to drugs, alcohol and contraband. As the other poster said, you are responsible for informing Social Security when you are being sentenced such that your benefits can be suspended. However, I have not seen any evidence that SSDI can be suspended based on a warrant - as long as you are free, your SSDI benefits are deposited without issue. NOTHING can take away SSI benefits. That's your own money, effectually, but untouchable. They couldn't take away OJ's, remember? You didn't murder anyone, so no worries (not that that would change anything either, hence the OJ example). I'm not sure about The Dept of Reh. I don't even know what that is. Hope this makes you feel a bit better. No you will not. Your benefits would be suspended however if you are in jail, but the would resume once your out. Also, SSDI would also suspend benefits is someone is has an open warrant. Many times SSA does not catch this in time and the beneficiary ends up owing an overpayment. only if you go to prison for a long period I'm not quite clear on why you asked, "If I take the felony charge..." If you can fight it, do so. I know that my friend is on Social Security Benefits for a disability and if she commits a crime, she can lose hers. Not only that, but if you try to take out a student loan you will be denied. Do everything you can for rehabilitation. You have an addiction, unfortunately instead of helping people, the system tends to make things worse. Fight it. Get the best attorney you can, even if it means working 2 jobs and living out of your car. In the long run it will be worth it. Don't lose hope, just keep going.... |
