Can creditors garnish my disability pay I receive from a private insurance company?



I HAVE BEEN %100 DISABLED FOR THREE YEARS. A LAWYER CALLED ME TODAY TELLING ME IF I DON'T PAY HE WILL GARNISH MY DISABILITY PAY THAT I RECEIVE FROM A PRIVATE INSURANCE COMPANY. CAN HE REALLY DO THIS?

Depends on the state and why are they attempting to garnish.

Typically, disability pay is not eligible for garnishment as it is not a wage. If you get your disability pay placed into your bank account they could take the funds that are in your bank account.

Again, there are different laws in each state regarding garnishment. You would need to research in your own state what laws there are concerning this.
