Is it legal for my employer to make me take an individual health insurance policy instead of company policy? |
they want me to pay for my own health insurance and them reimburse me for it. Because they said it is cheaper. Can they do that legally? It depends on what they are offering other employees. An employer does not legally have to provide health insurance at all. However, if they offer it to employees, they have to offer the same plan to all employees. They can offer you whatever they want to as long as everyone is getting offered the same thing. In some states, such as mine, this practice is illegal if the employer employs fewer than 50. I suggest you contact your state insurance commissioner's office and inquire. Other than that, there's no law that requires an employer to offer a group plan for employees. It is done all the time. Individual is less expensive than group for healthy people. It will save the co. money. They don't HAVE to offer group insurance. Small employers frequently don't HAVE a group policy for their employees. Are you positive that a group policy EXISTS for that employer? Because if there's no GROUP policy, then you can't GET a company policy!! Yes, it's legal, if there isn't a group policy in place! If there IS a group policy in place, it's odd, but not necessarily illegal. I've worked for SEVERAL small agencies (less than 7 employees) where there was NO group coverage - the principals were covered through their spouse's policies, and then the agency reimbursed everyone else for a private health policy. |
