Employee takes maternity leave for 4mo, we hold job and pay 1/2 health insurance during leave, then empl quits |
Now employee wants to be paid some mileage, and other misc. Do we have the right to charge the employee for the insurance we paid because we held job, and then they quit 2 weeks before coming back to work? Better check with your state labor board on this one. Here in Ca, we have SDI which covers that. If the mileage, etc was during her leave - no - you do not have to pay that. If it was before the leave - do check with the state labor board. I don't think so, but I also don't think you should pay her mileage or whatever misc stuff she asked for. Try to be civil about it and explain to her that she cost the company a lot of money by not coming back when she said she would. that is part of the benefits! If the leave fell within their provided benefits as an employee, then no. If you extended benefits to her beyond the normal limit, then determine what the cutoff would have been if she had come back to work, and deduct it from any remaining pay. No expert, just my 2 cents No you dont... maybe she was going to come back and changed her mind... pay up you can't make her pay insurance if it was a company paid program. also, if her mileage was accumulated while she was on the clock and it's company policy to reimburse for mileage, then guess what...you're paying for it. i would take this moment to visit the FMLA website and your company's policy on maternity leave. FMLA has stipulations like a 12-week leave...if the company offers more, then great for the employees. basically, it sounds like you got a bit screwed....sorry. take care. |
