So my wife had a car accident about 4 months ago... (health insurance question) PLEASE READ?



So the ER visit racked up about $3000 in doctors bills...and basically, my claims adjustor for my auto insurance company told me that I could claim the bills under my work health insurance AND my auto medpay. So, thats what I did. 3 days later, my auto insurance company gave me a check for $3000. Well, assuming that my work health insurance would pay it, I cashed the check. About 2 weeks later, my work health ins company sent me a letter that said "Please advise us if your auto insurance carries medpay. If so, the bill may be paid under that coverage." Well, I never replied to it. Today, I got a bill from my work health insurance for $3000...what do I do?!?!?

I'm going to agree with the other posters for most jurisdictions. However, not knowing which state you're in, it's impossible to answer your question. Some jurisdictions, like Montana for example, WILL let you double dip, so to speak. You can have you med pay reimburse you directly for medical bills while your health insurance pays the medical providers directly. It's ridiculous, but those are the facts in certain consumer friendly states. I suggest you call the local department of insurance to find out the laws in your state...
If your state is one in which auto insurance is primary, I suggest you pay back the money.

You 1st exhaust all your medical coverage under your auto insurance.........then........... only then............start using your health insurance to cover claims if your wife has any additional medical bills and you have used up your auto policy medical limits.

Example: You carry $3000 coverage per person on your auto policy. A certain person has $4000 in total meds.
Then, $1000 of the bills will go to your health insurance company for consideration.
They should be asking you quite a few questions on why you are submitting these $1000 worth of claims to them.
You need to contact your auto insurance people directly and then your health insurance people and get the mess straightened out.
In an auto accident, YOUR AUTO POLICY is to cover any medical bills 1st, not your health insurance.
Health insurance becomes a 2nd party to the claims AFTER you exhaust your auto medical limits.
IF your wife's accident involves another driver, then both of these companies are possibly entitled to reimbursement of any paid claims they pay for you, especially if your wife is not at fault.
If this is an accident involving another driver, you best be getting legal counsel ASAP as well.
You're going to have to pay the $3,000.


Either you misunderstood what the adjuster said, or he gave you bum legal advice (not being a lawyer, I can understand that).

But the health carrier will take you to court and win on this one.

Your health carrier is correct, you owe the money. This is an issue of primary and secondary coverage. Sometimes you will have overlapping insurance coverage. This doesn't mean that you can collect from both, and pocket the money. Almost every health insurance policy will say that it is secondary to auto policies for injuries cause in a crash.
Bill = $3,000.00
Auto ins pays = $3,000.00
Balance = $0
Why is there a bill from the health insurance for $3,000.00? The bill was paid in full. There in no balance owed.
