Is the homeowner liable for someone injured during a roofing job? The roofing company has insurance but ....?

Really the only way there might be recourse against you is if your neglegence in some way contributed to the injury. If the worker was bit by your dog or you hit him with your car in the driveway or something like that.

But it is always a good idea to get a certificate of insurance from your contractor before he starts work. Your insurance agent can help you with what coverages and limits you should request. If the contactor cannot or will not produce this he is not a reputable contactor.

Regardless of fault or whether they have a case many times the lawyers will go after the guy with the money in hopes of a settlement knowing the guy they are going after is not going to want to run up a lot of legal fees. You want the guy they go after to be the insurance company not you.
No you are not responsible, you paid the roofer to work on the roof but you did not force him to go on the roof.

You did not create the hazard that caused the roofer to fall and the roofer is responsible for all safety issues that arise.
no you're not responsible. it's not your fault the roofer you hired is paying someone under the table. that's the whole thing with doing that is they're taking that chance. I'm sure if they try to roll onto you, you can go the state license board and complain because workers comp is a requirement. you could also go to the labor board.
No, the roofer has to be competent enough to stand on the roof and finish the job without falling off the roof.

Roofers are liable for thier own injuries. You can sue the company for intentional negligence of hiring untrained techs.

Falling from the roof has caused your blood pressure to rise. See your doctor and confirm. Keep your documents and tell the roofing company to pay for your doctor bills and the new roof!

Both of you have insurance so the injured is free to seek coverage from both. The contractors insurance is primary, but if damages exceed the policy then the secondary homeowners policy kicks in. The goal of all this insurance is to protect you from losing your house to the injured. That's why you need contracors to be insured but you still need to excercise common sense when hiring. If the workers look like they take too many chances, then you know how the show will go and should call it off.When someone is agile on a roof you can tell, conversely its even easier to see when they're not. I don't take chances with roof workers in my business. I've sent many "experienced" guys away because they had no clue. It's a skill that can be taught, but only if they want to listen. Some people have such a fear of heights they can never be trained. sadly some of these people won't quit and you have to let them go anyway. It's for their own good though. Next time make them wear safety harnesses, it's your house and you are ultimately responsible for what happens there. Good-luck
