Fell 2 yrs ago, homeowner filed claim today for injury, health insurance paid can co-pays be pd by other ins? |
I had partial knee replaced in Nov and had never had a police report made when I fell, A lawyer had said that without a police report he couldn't help me, so I let my health insurance pay, then the copays added up and I went to homeowner,she has admitted to remembering me falling (I still have scars) and filed a claim with her insurance to pay my copays. Now that I have her insurance addmitting liability can I just collect for the copays and not get my health insurance involved? OK, just because her homeowners policy says they'll pay the co-pays, that's NOT an admission of liabiltiy. The homeowners policy has a coverage called "medical payments" - it's a no-fault coverage for exactly what you are talking about - medical bills. The limit of coverage is usually $1000 to $5000, and it ONLY covers medical payments - not pain and suffering, or anything else. So. You can certainly submit whatever they ask for, and have them cover your co-pays, if they're willing. How it happened and if anyone else was responsible. They dont wanna pay if they dont have to. If you inform your insurance yourself how it happened, they themselves will probably fight to get her home insurance to cover the costs. But if you want pain and suffering, then you will have to sue her seperately. |
