Homeowners insurance Question plz help?



I live in a home I own and about 6 months ago a bad rain storm came trhough and blew some shingles off the roof.The roof was leaking so bad ,then it started coming through my ceilings in about 3 different places through out the house. I called insurance Co. they sent an adjuster out and said they would cover the intior damage.I had the roof replaced before the adjuster came out because the roofer stated the roof was old that's why the shingles blew off and this could possible happen again, so we just had the whole roof replaced, in order not to be in this situation again.The insurance Co. also stated if they would have seen the roof were the shingles blew off they would have paid for part of the roof replacement , but it was to late since we didn't take picture or wait for them to see it.Well any ways the repair men started takeing down dry wal ceilings etc, about 3 months later and found wet rotten wood were there rain damage was and now the insurance co. is refusing to pay.

No property insurance policy will pay for continuous exposure to water - indicated by rot. If you have rotted wood, you have a continuous exposure to water.

Take a garden hose and spray a piece of wood. It's now wet but it isn't rotted.

Leave that piece of wood exposed to the weather long enough and you will eventually see it give way to rot and perhaps even fungus.

Adjusters are there to service their insureds and will pay claims unless they know for certain that there is no coverage. Generally, the adjuster arrives on scene to see water damage but cannot see the framing behind the wall. Unless there are signs of rot, such as soft subfloors or mold growing on the wall, the adjuster will assume the water damage is the result of a sudden and accidental exposure to water (whether by weather or burst plumbing or whatever) and proceed with coverage. If rot is found later, the adjuster will not be able to pay. All property policies exclude damage caused by a continuous exposure to water. With roofs, such a continuous exposure often comes by degraded seals around things piercing the roof such as vent stacks, chimneys, etc. That's possible in your case.

It appears to me that the adjuster has done exactly as the policy says.
the wood that is rotten is considered structural damage. I would contact the insurance company and provide them the information that was given to you by the roofers, stating that if it was not fixed immediately you would have had further damage. If you placed your claim with the ins. company before the roofers did the work, it shouldn't matter who did the job, just that the ins. will cover it. Maybe see if the roofers can provide you with something in writing stating that the damage was caused by that particular storm, and present it to the ins. company.
Unfortunately, rot is not covered. Like the first answer stated, the rot is not from one incident, it takes time and several occurrences. I would contact a company that has framing experience to take a look and give you a bid. The insurance should cover the rest. Good luck!

OK, rot is never covered. It ALSO doesn't happen in six months - it's a long term issue, like YEARS.

I would guess that when you BOUGHT this house, the roof needed to be replaced. It's actually possible that there was prior unrepaired damage, and the seller didn't disclose it to you? In which case you COULD have a lawsuit (aka, recourse) against the seller, to recoup all your damages.

You should have (I know, too late now) been talking to your agent. Your agent should have been able to arrange an "insurance company approved" contractor to be there MUCH sooner than 5 months - that's a silly wait.
